WHAT IS THIS LITIGATION ABOUT?
A class action settlement was proposed in the United States District Court for the Southern District of California, called Reed v. 1-800 Contacts, Inc. This lawsuit claimed that the defendant, 1-800 Contacts, Inc., recorded telephone calls received from or placed to California in violation of California law. Defendant, 1-800 Contacts, Inc. denied this claim.
WHO IS INCLUDED IN THE CLASS?
You were included in the class if, while present in California, you participated in at least one recorded telephone call with 1-800 Contacts, Inc. between August 15, 2011 and September 10, 2012.
WHAT DOES THE SETTLEMENT PROVIDE?
Defendant paid the total amount of $11,700,000. The Settlement Amount will be used to pay the claims of Class Members who returned valid Claim Forms, as well as the attorneys' fees and litigation expenses of Class Counsel, a service payment to the Plaintiff, and the costs of claims administration. Each Class Member who returned a valid and timely Claim Form received an equal share of the net amount remaining after payment of attorneys’ fees, litigation expenses, a service payment to the Plaintiff, and the costs of administration.
HOW WERE PAYMENTS DETERMINED?
Each eligible Class Member received an equal share of the remaining net amount ($8,288,719.16). There were a total of 13,665 eligible claims making each check $606.57.If you received less than $606.57 see FAQ concerning taxes.
WHAT IF I RECIEVED A CHECK, BUT IT WAS THEN LOST OR DESTROYED?
Please send a written request stating the check was lost or destroyed. Your request should also include your name, claim number, and your daytime telephone number. Please allow for 3 to 4 weeks for a check to be reissued.
